Canada’s Impact Assessment Act, 2019: Indigenous Peoples, Cultural Sustainability, and Environmental Justice

It is well documented that the colonizers of Canada have long coveted ancestral homelands Canadian Indigenous peoples for settlement and development. With this end goal in mind, it not surprising there exists an extensive history assimilative efforts by with respect to Canada—for example, legal assimilation through enfranchisement (voluntary involuntary) blood quantum requirements, cultural residential schools “sixties scoop”. Another form environmental assimilation, is, colonial development on extent whereby activities can no longer be supported development-transformed environment. Herein, I examine Bill C-69, a Government omnibus bill, justice lens context across impacts sustainability. Specifically, Part 1 (i.e., Impact Assessment Act, 2019) 3 Navigable Waters C-69 pose significant threats Through lens, procedural aspects include use project list scheduled waterways, discretionary decision-making powers representatives, lack acknowledgement elements assessment processes are constitutionally protected comprehensive land claims.
